1. Eligibility to Participate. Subject to the additional restrictions below, Re-Bath® of New Mexico, 5 Day Kitchens™ of Albuquerque Remodeling Giveaway (“Promotion”) is open to legal residents of New Mexico, who at the time of entry: 1) are 21 or older; and 2) Own their home (located within Re-Bath® of New Mexico, 5 Day Kitchens™ of Albuquerque’s regular service area, for details contact Re-Bath® of New Mexico, 5 Day Kitchens™ of Albuquerque) and have proof of such ownership.

2. How to Enter. The Promotion will begin at 12:00 a.m. E.T. on September 29, 2018 and will end on or about September 30, 2019 (The “Promotion Period”). During the Promotion Period, you can enter the Promotion by completing an application form at Poulin Design Center of online. Only one (1) entry per person is permitted during the Promotion Period. Sponsor will not be responsible for incomplete, late, or misdirected entries or for failure to receive entries.

3. Selecting the Winner. On or about September 30, 2019, Sponsor will select one (1) Grand Prize Winner in a random drawing from among all eligible entries received during the Promotion Period. The odds of winning depend on the number of eligible entries received.

4. Prize Description. Subject to verification of eligibility and compliance with these Official Rules, the Grand Prize Winner will receive a certificate good for ten thousand dollars ($10,000) towards a bathroom or kitchen remodel to be performed by Re-Bath® of New Mexico, 5 Day Kitchens™ of Albuquerque. Under no circumstances will more than one (1) Grand Prize, or a Grand Prize exceeding the amount of ten thousand dollars ($10,000) be awarded in connection with the Promotion. All remodel work (including any and all work exceeding the value of the certificate) must be performed by Re-Bath® of New Mexico, 5 Day Kitchens™ of Albuquerque and the Prize cannot be combined with any other offer or with work performed by any other entity.

5. Notification of Official Prize Winner and Prize Claim. Sponsor will notify the Potential winner by telephone and/or email. Sponsor’s inability to reach potential winner and/or potential winner’s failure to timely respond to prize notification or to comply with any term or condition of these Official Rules may, in Sponsor’s discretion, result in the Potential winner’s disqualification, the forfeiture of his or her interest in the Grand Prize and the selection of a substitute Potential winner from among all the remaining eligible entries. Sponsor will conduct up to four alternative drawings, after which the Grand Prize will remain un-awarded.

6. Additional Requirements. Potential winner will be required to complete an affidavit of eligibility and publicity release (except where prohibited by law), which must be signed and returned to Sponsor within five (5) days of notification in order to claim Grand Prize. Failure to timely sign and return the affidavit and release may result in the Potential winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute potential winner. Potential winner will also be required to enter into a contract, in the form typically used by Re-Bath®, 5 Day Kitchens™, consistent with applicable law. Sponsor shall work with Potential winner to provide a bid for the remodel work requested. Sponsor shall not be required to reduce its bid or make its bid lower than the Prize amount. There is no guarantee Potential winner will be able to obtain a complete remodel for less than the Prize amount. Failure of the potential winner to execute a contract, as described above, and accept a bid from Re-Bath®, 5 Day Kitchens™ may result in the Potential winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute potential winner.

7. Non-Assignability. Grand Prize Winner may waive his or her right to receive the prize. Prize is non-assignable and non-transferable. No substitutions allowed. Grand Prize Winner is solely responsible for reporting and payment of any taxes on the prize and will be required to complete an IRS W-9 Form.

8. Limitations of Liability, General Release and other Limitations. By entering the Promotion, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Promotion, or any prizes award, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and cause of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney’s fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights have to damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

9. Reservation of Rights. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor. The decisions of Sponsor regarding the selection of the Grand Prize Winner and all other aspects of the Promotion shall be final and binding in all respects. Sponsor reserves the right to disqualify persons found to be improperly tampering with any aspect of this Promotion as solely determined by Sponsor.

10. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.
